PLEASE READ CAREFULLY BEFORE SIGNING. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.
ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNIFICATION AGREEMENT
In consideration of being permitted to rent and use the private tennis/pickleball court located at 12350 Musket Ln, Fort Myers, FL 33912(“Premises”), the undersigned renter (“Renter”) hereby acknowledges and agrees as follows:
1. Acknowledgment of Risks
I understand and acknowledge that playing tennis, pickleball, or engaging in any physical activity on the Premises involves inherent risks, including but not limited to:
I voluntarily assume all such risks, known and unknown, even if arising from the negligence of c20 Holdings LLC or others.
2. Release and Waiver of Liability
I, on behalf of myself, my heirs, assigns, personal representatives, and estate, hereby release, waive, discharge, and covenant not to sue:
(collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur during my use of the Premises, even if caused by the negligence of the Released Parties.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, lawsuits, damages, liabilities, or expenses (including reasonable attorneys’ fees) brought by or on behalf of myself, my guests, or any third party, arising from:
4. Physical Condition & Medical Care
I represent that I am in good physical condition and have no medical or physical condition that could interfere with my safety or the safety of others. I authorize the Released Parties to seek emergency medical treatment on my behalf if I am unable to do so, and I agree to bear all costs associated with such care.

Failure to comply may result in immediate termination of access without refund.
6. Property Damage
I am responsible for any damage to the court, equipment, or surrounding property caused by me or my guests. I agree to reimburse c20 Holdings LLC for repair or replacement costs.
7. Photography & Recording
I consent to being photographed or recorded during my visit. c20 Holdings LLC may use such media for promotional purposes without compensation.
8. Governing Law
This Agreement shall be governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the courts of Lee County, Florida.
9. Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
10. Assumed Consent
By stepping foot on the court you are agreeing to ALL TERMS AND CONDITIONS.
Refund Policy
No refunds will be given. If your time is altered by weather you may reschedule if your time was cut short by over 60%.
Your time starts on the hour, if you are late you do not get to continue into the next hour. If you are caught doing so you will be charged 3 times the going rate of that time. You can book more than one hour at a time.
You are expected to act in a professional and courteous manner at all times. Foul language and altercations will not be tolerated and you will lose your current reservation and not be allowed back at the property. The owner reserve the right to refuse service to anyone for any reason.
